India detains second DPRK ship

UPDATE 2: Last month, South Korea seized a North Korean shipment to Syria which contained hazmat suits “to guard against nuclear, biological or chemical infection”. The four containers that were confiscated in Busan contained the Russian-made suits (or North Korean-made but copied from Russian designs). The report’s lead says that the items were related to chemical weapons, but the rest of the report doesn’t explain why it believes it was chemical-related and not biological or nuclear.

UPDATE 1:  South Korea also searched containers shipped by the DPRK on a Panamanian ship.  According to Yonhap:

South Korea confiscated and searched containers shipped by North Korea on a Panama-registered freighter last month but reportedly found no suspicious cargo, according to sources Monday.

The National Intelligence Service (NIS) and relevant authorities on Sept. 22 ordered an inspection of the ship docked in the southeastern port of Busan and searched the four containers, a government official said, requesting anonymity.

The official said authorities found some kind of protective clothing but did not elaborate further.

A port official in Busan also confirmed that the NIS ordered the search, saying it received tips that the containers could be carrying hazardous material. The ship carrying the containers had arrived from China last month.

“Nothing particular was discovered from the search, but I’m aware that the government is still in the process of confirming the results,” the port official said, refusing to elaborate.

ORIGINAL POST: Last August the Indian government detained and searched a North Koren vessel that was anchored in Indian waters.  This week, the Indian government stopped and searched a second vessel anchored in Indian waters.  According to the Telegraph (of India):

The Indian Coast Guard detained a North Korean vessel for the second time in two months but gave the all-clear to the ship found anchored without permission off the Kerala coast today.

A spokesperson for the navy and the Coast Guard, Commander Roy Francis, said the Hyangro was found stationary in Indian waters when it was supposed to be sailing to Karachi, Pakistan. Coast Guard and naval personnel boarded the ship but found it was carrying no cargo.

The Hyangro was surrounded by two Coast Guard vessels and a naval warship after fishermen reported its presence to the authorities.

The captain of the ship told the investigators he had dropped anchor “because of technical problems in the ship’s tanks that were leaking”. The ship had last made port in Colombo. It is owned by the Pyongyang-based Sinhung Shipping Company.

A navy source in Delhi said later this evening that the crew of the Hyangro had been cleared after questioning. The entire crew of 44 was North Korean.

A UN resolution empowers member countries to inspect North Korean cargo being transported by sea, land or air.

UAE Seizes North Korean Weapons Shipment to Iran

UPDATE: According to Yonhap, Chinese and Australian ships were shipping the arms:

North Korean cargo carrying arms exports to Iran left a western port five days after Pyongyang’s nuclear test in May and was transferred aboard Chinese and Australian freighters before being seized by the United Arab Emirates (UAE) in July, according to an Italian company that handled the delivery.

Mario Carniglia, head of the international freight-forwarding firm Otim, said the containers, reportedly loaded with rocket launchers, detonators, and munitions, were shipped via the Chinese cities of Dalian and Shanghai and were transferred to an Australian vessel just after the U.N. Security Council adopted Resolution 1874 which bans the North from engaging in arms trade.

“(The containers) left the Nampo Port on May 30,” he said in a recent interview with Yonhap News Agency in Rome on Wednesday. A North Korean ship carrying the 10 containers arrived in Dalian two days later and a Chinese cargo ship moved them to Shanghai on June 13, he said.

“The containers were placed on (the Australian freighter) ANL-Australia in Shanghai,” he said, flipping through related documents.

The cargo was on its scheduled course until the UAE intercepted the ANL-Australia on July 22. The U.S. Navy had been focusing on trailing another North Korean vessel, the Kangnam 1, which appeared to be headed to Myanmar also carrying weapons exports.

The seizure was the first made under Resolution 1874 that calls upon all states to inspect cargo to and from North Korea if they have “information that provides reasonable grounds to believe the cargo contains” illicit weapons.

The Australian government said earlier, based on its own probe, that there were rocket-propelled grenades and other weapons in the seized containers, though Carniglia said his firm did not know the contents of the cargo.

He said North Korea provided documents identifying the content as “Oil Pumping Equipment.”

“We couldn’t see the contents as the containers were sealed when shipped from Nampo,” he said in the interview conducted in Italian. He refused to identify the exporter in North Korea, citing business ethics.

“All we were responsible for was handling the shipping from China to Iran,” Carniglia said.

He added that North Korea has not filed a complaint or asked for the return of the cargo, held at the UAE now for more than 50 days.

The UAE is reportedly in consultation with the U.N. sanctions committee on how to handle the seized shipment.

In a related move, the U.N. committee demanded an explanation from North Korea last month for the apparent arms export attempt.

The head of the North’s mission to the U.N., Sin Son-ho, sent a reply letter reiterating his country’s position that it is not bound by any U.N. resolution.

Sin also said that North Korea’s experimental uranium enrichment program is in a “completion phase,” claiming the country has made advancements in mastering an alternative route to producing nuclear weapons apart from its plutonium-based program.

ORIGINAL POST: According to Bloomberg:

The United Arab Emirates has seized a ship carrying North Korean-manufactured munitions, detonators, explosives and rocket-propelled grenades bound for Iran in violation of United Nations sanctions, diplomats said.

The UAE two weeks ago notified the UN Security Council of the seizure, according to the diplomats, who spoke on condition they aren’t named because the communication hasn’t been made public. They said the ship, owned by an Australian subsidiary of a French company and sailing under a Bahamian flag, was carrying 10 containers of arms disguised as oil equipment.

The council committee that monitors enforcement of UN sanctions against North Korea wrote letters to Iran and the government in Pyongyang asking for explanations of the violation, and one to the UAE expressing appreciation for the cooperation, the envoys said. No response has been received and the UAE has unloaded the cargo, they said.

he Security Council voted on June 12 to adopt a resolution that punishes North Korea for its recent nuclear-bomb test and missile launches through cargo inspections and enforcement of restrictions on financial transactions. The measure calls for the interdiction at seaports, airports or in international waters of any cargo suspected of containing arms or nuclear or missile-related materials going to or from North Korea.

According to the Wall Street Journal:

According to the Security Council diplomat, the weapons were carried on an Australian vessel, the ANL-Australia, which was flying under a Bahamian flag. According to an Aug. 14 letter sent to the U.N. sanctions committee, the exporting company was an Italian shipper, Otim, which exported the items from its Shanghai office.

“The cargo manifest said the shipment contained oil-boring machines, but then you opened it up and there were these items,” the diplomat said. ANL and Otim officials couldn’t immediately be reached to comment.

A spokeswoman for the Australian Department of Foreign Affairs and Trade said the Australian government is aware of the incident and is investigating to determine whether any Australian laws may have been broken.

The seizure could also raise fresh questions about North Korea’s intentions. After taking an aggressive stance against the West earlier this year, Pyongyang appears to have softened its rhetoric, releasing two captive American journalists and sending a delegation to meet with South Korea’s president.

DPRK shipping sugar to Iraq

But it transpired later that the management of the shipping company had asked the Mu San to loiter in Indian waters because they might get a better price for their cargo in India.

ORIGINAL POST: This week there was a worry that another North Korean ship might be carrying military goods to Myanmar in violation of UN sanctions.  Despite the strange behavior of the North Korean crew, the ship appears to be shipping sugar to Iraq!

First–the chase (According to the New York Times):

The ship anchored without authorization in the Andaman and Nicobar Islands, a territory of India in the Bay of Bengal, last week, according to the Indian military.

Indian officials said it was carrying more than 16,000 tons of sugar bound for the Middle East. But the ship’s proximity to Myanmar, a North Korean ally, and the fact that it had no apparent reason to be in the area raised suspicions.

The coast guard intercepted the ship after chasing it for six hours, and detained 39 North Korean crew members.

After two days of searching and of questioning the crew, India’s Navy and Coast Guard handed the ship over to police and intelligence services, having found no evidence of illegal cargo, according to the Press Trust of India.

Ashok Chand, a senior police officer in the Andaman and Nicobar Islands, told Reuters that further tests were being conducted.

But it remains a mystery why the ship was in Indian waters at all.

India has watched warily for signs that North Korea is helping Myanmar build a nuclear reactor.

The investigation turned up some strange detials, but no UN violations.  According to UPI:

A preliminary search showed the ship, as stated by its captain, was transporting 16,000 tons of sugar from Thailand to Iraq, Indian media reports said.

The ship, M.V. Mu San is detained at Port Blair after dropping anchor without authorization off Hut Bay in the Andaman and Nicobar Islands in the Bay of Bengal Wednesday.

Mu San sailed off Thailand’s Laem Chabang port July 27 but an investigation showed it berthed in Singapore three days later, although that was not a port of call, and that the crew’s passports were not stamped in Singapore, the Times of India reported.

The report said authorities were interrogating the ship’s captain Yon Jung-sun and the other 38-member crew, with only one or two among them speaking English.

North Korea’s Merchant Marine fleet

Merchant marine may be defined as all ships engaged in the carriage of goods; or all commercial vessels (as opposed to all nonmilitary ships), which excludes tugs, fishing vessels, offshore oil rigs, etc. This entry contains information in four fields – total, ships by type, foreign-owned, and registered in other countries.

Total includes the number of ships (1,000 GRT or over), total DWT for those ships, and total GRT for those ships. DWT or dead weight tonnage is the total weight of cargo, plus bunkers, stores, etc., that a ship can carry when immersed to the appropriate load line. GRT or gross register tonnage is a figure obtained by measuring the entire sheltered volume of a ship available for cargo and passengers and converting it to tons on the basis of 100 cubic feet per ton; there is no stable relationship between GRT and DWT.

Ships by type includes a listing of barge carriers, bulk cargo ships, cargo ships, chemical tankers, combination bulk carriers, combination ore/oil carriers, container ships, liquefied gas tankers, livestock carriers, multifunctional large-load carriers, petroleum tankers, passenger ships, passenger/cargo ships, railcar carriers, refrigerated cargo ships, roll-on/roll-off cargo ships, short-sea passenger ships, specialized tankers, and vehicle carriers.

North Korea on Google Earth v.18

North Korea Uncovered version 18 is available.  This Google Earth overlay maps North Korea’s agriculture, aviation, cultural locations, markets, manufacturing facilities, railroad, energy infrastructure, politics, sports venues, military establishments, religious facilities, leisure destinations, and national parks.

This project has now been downloaded over 140,000 times since launching in April 2007 and received much media attention last month following a Wall Street Journal article highlighting the work.

Note: Kimchaek City is now in high resolution for the first time.  Information on this city is pretty scarce.  Contributions welcome.

US and UN responses to the DPRK’s nuclear test no.2

UPDATE: In response to the resolution, the DPRK has made some serious threats.  According to the Telegraph:

A commentary in the North’s state-run Rodong Sinmun newspaper claimed the US had 1,000 nuclear weapons in South Korea ready to strike. 

Meanwhile, the Tongbil Sinbo newspaper said that North Korea is “completely within the range of US nuclear attack and the Korean peninsula is becoming an area where the chances of nuclear war are the highest in the world.” 

Over the weekend, North Korea angrily responded to fresh United Nations sanctions by threatening to build as many nuclear weapons as possible. 

Until now, it said, it had only reprocessed one-third of its spent fuel rods into weapons-grade plutonium. Analysts believe the rogue state could end up with enough plutonium to make eight to nine bombs. 

The rogue state also claimed to have a uranium-enrichment programme, the first time it has admitted to one. The claim is alarming, said Professor Yang Moo-Jin, of Seoul’s University of North Korean Studies. 

“The North has abundant natural uranium of good quality, which, if combined with technology and facilities, would result in a great nuclear arsenal,” he said.  

UPDATE:  The United Naitons Security Council (UNSC) has passed a new resolution in response to the DPRK’s second nuclear test.  Althought the text of the resolution has been posted to the UNSC web page (here), below are the economically significant excerpts (taken from Reuters).  The resolution…

1. Calls upon all States to inspect, in accordance with their national authorities and legislation, and consistent with international law, all cargo to and from the DPRK, in their territory, including seaports and airports, if the State concerned has information that provides reasonable grounds to believe the cargo contains items the supply, sale, transfer, or export of which is prohibited;

2. Calls upon all Member States to inspect vessels, with the consent of the flag State, on the high seas, if they have information that provides reasonable grounds to believe that the cargo of such vessels contains items the supply, sale, transfer, or export of which is prohibited;

3. Calls upon all States to cooperate with inspections pursuant to paragraphs 11 and 12, and, if the flag State does not consent to inspection on the high seas, decides that the flag State shall direct the vessel to proceed to an appropriate and convenient port for the required inspection by the local authorities pursuant to paragraph 11;

4. Decides that Member States shall prohibit the provision by their nationals or from their territory of bunkering services, such as provision of fuel or supplies, or other servicing of vessels, to DPRK vessels if they have information that provides reasonable grounds to believe they are carrying items the supply, sale, transfer, or export of which is prohibited … unless provision of such services is necessary for humanitarian purposes;

5. Calls upon Member States … to prevent the provision of financial services … that could contribute to the DPRK’s nuclear-related, ballistic missile-related, or other weapons of mass destruction-related programs or activities;

6. Calls upon all Member States and international financial and credit institutions not to enter into new commitments for grants, financial assistance, or concessional loans to the DPRK, except for humanitarian and developmental purposes;

7. Calls upon all Member States not to provide public financial support for trade with the DPRK … where such financial support could contribute to the DPRK’s nuclear-related or ballistic missile-related or other WMD-related programs or activities;

In the Washington Post, Marcus Noland asserts that this sanctions plan is “clever”. Instead of a “crime and punishment” approach to North Korea, he said, the proposed sanctions are “basically defensive,” relying on interdiction of ships and global financial restrictions. He also went on to say, “The North Koreans will be down to whatever China gives them and whatever they can get from their subterranean customers in the Middle East.”

The Washington Post also states:

But there is little chance that these tougher sanctions will limit the ability of Kim Jong Il’s government to profit from more conventional overseas trade, said Lim Eul-chul, a researcher who specializes in North Korean trade for the Seoul-based Institute for Far Eastern Studies.

“The sanctions will not have much effect on what North Korea trades with China,” he said.

North Korea consistently fails to grow enough food to feed its 23 million people, and its state-controlled economy is moribund, but it does have mineral resources that are coveted by many industrialized countries.

The estimated value of its reserves — including coal, iron ore, zinc, uranium and the world’s largest known deposit of magnesite, which is essential for making lightweight metal for airplanes and electronics — is more than $2 trillion, according to the Korea Chamber of Commerce and Industry.

The manufacturing boom in neighboring China has dovetailed with North Korea’s acute need for hard currency and has accelerated Chinese access to the North’s resources, according to Lim, Chinese mining experts and South Korean government officials. There is, however, a significant new wrinkle in the North’s trade with China, Lim said. “The military is taking control of export sales,” he said, citing informants inside North Korea.

Other branches of the North Korean government, such as the Workers’ Party and the cabinet, have been forced to relinquish their interest in these sales to the military, Lim said. The military has grabbed greater control of export revenue, he said, as it has provoked the outside world with missile launches and the nuclear test.

Based on the recent growth of North Korean-Chinese trade, Lim said he does not believe that China wants to “take any strong measures to crush the North Korean economy.”

An article in the New York Times expresses sckepticism that these new sanctions will deter North Korea’s nuclear ambitions:

This time, in addition to financial sanctions, the proposed Security Council resolution calls for a tighter arms embargo, possible interdiction of North Korean vessels. But most analysts say that none of the threats are large enough to stop a regime that sees nuclear weapons as the key to its survival, and that has endured decades of economic sanctions and hardships, including even starvation, rather than capitulate to outside pressure.

“These are people who didn’t flinch even when 2 million of their own people died of hunger,” said Lee Ji-sue, a North Korea specialist at Myongji University.

And that is assuming that the sanctions are fully enforced. While many of these same measures have been included in previous U.N. resolutions, nations like China and Russia were reluctant to enforce them to avoid antagonizing the North.

Critics and proponents alike agree that the linchpin in making any sanctions work is China, North Korea’s primary aid and trade partner. China shares an 850-mile border with North Korea, and its $2 billion annual trade with the North accounts for over 40 percent of Pyongyang’s entire external trade, according to South Korean government estimates. North Korea’s trade with China expanded by 23 percent just last year, the South Korean government said.

Both United States and South Korean officials fear that although Beijing was disappointed by the North’s continued tests, it remains reluctant to push too hard. They say China fears causing a collapse by the Pyongyang regime that could flood it with refugees and create a newly unified, pro-American Korea on its border.

Finally, The Economist weighs in with some critical analysis:

It is hard to envision that the new sanctions will bring North Korea back to the negotiating table. With few exceptions, previous rounds of economic sanctions have had little impact. In the present case, unanimity was achieved at the price of watering down the provisions that require other countries to search North Korean vessels. The final compromise—that North Korean ships are required to undergo searches but cannot be forced to do so—is hardly a recipe for effective enforcement.

As in the past, China—and Russia, to a lesser extent—may have supported the new sanctions primarily to send North Korea a message of unified international condemnation. But North Korea will hardly infer from the passage of a murkily worded, patchily enforced resolution that it has exhausted its ability to wring concessions from its neighbours and exploit their differences. Moreover, even if the new measures are consistently enforced, it’s not clear that punishments designed to put economic and diplomatic pressure on North Korea will change the regime’s behaviour. North Korea is already one of the most isolated and desperately poor countries in the world.

Divergent interests
A lasting solution to the North Korea problem will require more than just agreeing a common approach and collectively enforcing sanctions. The main problem is not just North Korea’s unpredictability, which is, after all, predictable. It is that there are also major differences between the various interested powers in terms of how they assess the threat and what they view as the optimal outcome.

Although China’s influence over North Korea is often overstated, China alone has the economic leverage to force the regime back to the bargaining table. China’s dilemma, however, is that there may be a fine line between the amount of pressure sufficient to force the stubborn regime to make concessions and the amount that would precipitate its collapse. The fall of the current regime would almost certainly result in a massive humanitarian crisis (more accurately, China would suddenly bear the brunt of the crisis already wracking its chronically famine-stricken neighbour). For China (and Russia) the collapse of North Korea would also be a big strategic setback. The bonds of communist solidarity may have faded since Mao Zedong sent hundreds of thousands of soldiers to fight US-led UN forces during the Korean war—but North Korea remains a buffer state, the loss of which could result in a united, US-allied Korean peninsula.

ORIGINAL POST: The DPRK has historically faced few substantive repercussions from its missile and nuclear tests due to roles that Russia and China occupy both in the UN Security Council and in their status as North Korea’s neighbors, trading partners, and investors. Russia is developing the DPRK’s Rason Port and seeks to build a natural gas pipeline through the DPRK to South KoreaChina is the DPRK’s largest trading partner. And of course, hundreds (maybe thousands?) of  North Koreans work in both China and Russia to earn foreign currency for their government.

So how have China and Russia responded to the most recent nuclear test and missile launches? China has issued some tough language condeming the test and supposedly canceled some cultural exchanges, and  Russian President Medviev has also expressed concern in the

Western business media:

We have always had good relations with the North Korean leadership. But what has happened raises great alarm and concern. I have had quite a number of telephone talks with the Prime Minister of Japan and the President of South Korea. We need to think about some measures to deter those programs that are being conducted. We hope the North Korean leadership will get back to the negotiating table, because there is no other solution to this problem. The world is so tiny—as we see from the economic problems common to all of us. But indeed, WMD development or [nuclear] proliferation is a danger that is even higher than that. I’m prepared to discuss this matter in more detail during our meeting with President Obama in Moscow in early July. And we’re going to discuss this in other forums also.

As the UN Security Council debates a resolution in response to the DPRK’s recent nuclear test and missile launches, China appears to be the DPRK’s strongest partner.  According to the New York Times:

Negotiations over toughening sanctions against North Korea in the wake of its underground nuclear test last month have stalled over the issue of inspecting cargo ships on the high seas, according to two Security Council diplomats. China has yet to sign off on the idea that North Korean vessels could be stopped and searched, the diplomats said. Ambassadors from the five permanent members of the Security Council — the United States, Russia, China, Britain and France — plus Japan and South Korea, locked in intensive bargaining sessions all week, have agreed on other issues, including widening an arms embargo and financial restrictions, the diplomats said. North Korea has declared cargo inspections an act of war.

So it looks like Russia is “ok” with searching the DPRK’s cargo ships?  That is surprising.

Aside from inspecting cargo ships, the US is pushing for the UNSC resolution to restrict the DPRK from the global financial system (a la Banco Delta Asia).  According to the Washington Post:

State Department spokesman P.J. Crowley confirmed yesterday that the United States was considering targeting North Korea’s access to financial markets. A draft of the resolution urges U.N. member states to cut loans, financial assistance and grants to North Korea and its suppliers for programs linked to its military program. The draft also expands an asset freeze and travel ban.

The Bush administration applied similar financial pressure in 2005, infuriating Pyongyang. Crowley noted that, during a tour of Asian capitals this week, Deputy Secretary of State James B. Steinberg was accompanied by Treasury Undersecretary Stuart A. Levey, the architect of the Bush-era sanctions.

“Obviously, Stuart Levey’s presence on this team would indicate that we’re . . . looking at other ways that we can bilaterally put pressure on North Korea to return to the negotiating process,” Crowley said.

Additionally, the Obama administration has signaled that it might take the advice of John Bolton, former President Bush’s UN ambassador.  According to the Washington Post:

The United States will consider reinstating North Korea to a list of state sponsors of terrorism, Secretary of State Hillary Rodham Clinton said in an interview broadcast yesterday as the Obama administration looks for ways to ratchet up pressure on Pyongyang after recent nuclear and missile tests.

 “We’re going to look at it,” Clinton said on ABC’s “This Week” when asked about a letter last week from Republican senators demanding that North Korea be put back on the list. “There’s a process for it. Obviously we would want to see recent evidence of their support for international terrorism.” 

Secretary of State Clinton’s comment “we would want to see more evidence of their support for international terrorism” refers to a legal requirement for any nation to be added to the list.

The most recent version of North Korea Uncovered (North Korea Google Earth) has been published.  Since being launched, this project has been continuously expanded and to date has been downloaded over 32,000 times.

Pictured to the left is a statue of Laurent Kabila of the Democratic Republic of Congo.  This statue, as well as many others identified in this version of the project, was built by the North Koreans. According to a visitor:

From the neck down, the Kabila monument looks strangely like Kim Jong Il: baggy uniform, creased pants, the raised arm, a little book in his left hand. From the neck up, the statue is the thick, grim bald mug of Laurent Kabila (his son Joseph is the current president). “The body was made in North Korea,” explains my driver Felix. In other words, the body is Kim Jong Il’s, but with a fat, scowling Kabila head simply welded on.

This is particularly interesting because there are no known pictures of a Kim Jong il statue.  The only KJI statue that is reported to exist is in front of the National Security Agency in Pyongyang.  If a Kim Jong il statue does in fact exist, it might look something like this.

DPRK’s shipping infrastructure

This week, Paul Eckert of Reuters informs us of an interesting study by Hazel Smith, titled, North Korean Shipping: A Potential for WMD Proliferation?.

According to the Reuters article:

British North Korea expert Hazel Smith said her detailed study of North Korean merchant shipping showed a fleet of only 242 aging vessels faces too much scrutiny in the world’s ports to be a significant conduit for weapons of mass destruction.

“We can’t really find very much hard evidence of North Korean ships involved in smuggling WMD or components of WMD,” Smith, of Cranfield University, told a Washington meeting of think tank East-West Center.

The weapons of mass destruction trade North Korea conducts, such as missile sales to Iran or Pakistan, is more likely moved by aircraft or allied vessels than on highly suspect North Korean-owned or -flagged ships, her report said.

Her findings, based on tracking ship movements using Lloyds Shipping Register and other insurance databases, call into question the efficacy of the Proliferation Security Initiative, a U.S.-led network of countries launched in 2003 to stop illicit weapons of mass destruction shipments because that effort focuses on shipping, she said.

Anti-proliferation efforts should instead focus on strengthening port controls and negotiating North Korean entry into international arms control treaties as part of a broader disarmament diplomacy with Pyongyang, Smith said.

HIGHLY SUSPECT SHIPS

North Korea’s fragmented merchant shipping industry has only a handful of directly state- or provincial-owned vessels, with most run by small owner operators, who lost state subsidies in the early 1990s, said the study.

With underpaid seamen, dilapidated vessels and dire cash and food shortages in North Korea, “it wouldn’t be surprising if crew and management would grasp opportunities to earn cash on the side from port calls,” Smith told the East-West Center, which published her report.

But even countries friendly toward North Korea such as China, Russia and Vietnam impose strict inspections on North Korean merchant ships, which are frequently stopped and even detained for serious safety violations, said the report.

In four publicly known cases between 1992-2003 in which North Korean vessels were stopped on suspicion of shipping WMD components or chemicals, none were prosecuted because the cargo was either undetermined, legal or “dual-use,” with legal applications Smith said.

The possibility that North Korean ships may be smuggling weapons of mass destruction is a matter of intense concern in the Asia Pacific region and beyond. The few reported incidents of North Korean ships involved in WMD transport are ambiguous; some ships have been engaged in legal weapons trade and some carried “dual-use” goods suitable for use in nonmilitary applications, like agriculture. Ownership of the North Korean merchant fleet is largely private and highly fragmented; most of its ships are small, old, and in poor repair, and are often subject to rigorous scrutiny in foreign ports. The inability of the government to effectively regulate the low-cost, substandard shipping industry creates the risk and incentives to smuggle goods, including WMD. Anti-proliferation efforts should abandon the divisive and unsuccessful Proliferation Security Initiative and concentrate on negotiating North Korea’s entry into international arms control treaties, maintain stringent port controls, and negotiate technical assistance to reduce the vulnerability of the North Korean shipping industry.

North Korea’s transformation: A legal perspective

The Institute for Far Eastern Studies (IFES) published an interesting paper (with the above title) on legal reform in the DPRK.  Below are some highlights.  Links to the entire paper at the bottom.

As citizens have been left without state provisions for subsistence since the state did not have the material resources to supply the people through its central rationing system, the vast majority of individuals and organizations had to support themselves. Legitimizing commercial and market activity and expanding the scope of private ownership were a part of this effort. One of the most important laws reflecting this transformation is the Damage Compensation Law (sonhae bosang-beop), which is the North Korean version of a general torts law. This law holds an individual or any legal entity liable for its tort when damage is inflicted. Monetary compensation is the rule, while restoration is allowed when possible.

Under the socialist system, where the state is responsible for the provision of a citizen’s livelihood, tort law was of little use. Even in the case of death, one’s family would not suffer economically since the state provided sustenance rations. However, with the collapse of the public distribution system, the North Korean authorities could no longer maintain their socialist system. Since an individual now has to rely on his or her own devices, the loss of the employment, for example, directly inflicts a financial burden on the individual or family. Therefore, damage to property or person should be compensated for by the responsible party. Therefore, the new damage compensation law acts as a new mechanism for the protection of private property, and strengthens individual responsibility for negligent acts that inflict damage on others.

Relaxation of law and order, along with the laxity of organizational control due to economic difficulties, changed individual attitudes toward government authorities and organizations in which these individuals were members. Individuals became more independent from the state and its organizations, since both the state and more directly engaged organizations lost important means of control over individuals in society due to the lack of resources and the inability to provide basic necessities to the people.

Under these circumstances, individual victims had no appropriate method to seek compensation for damage through an official dispute resolution process. This has led to an environment in which self-remedy has become the rule, rather than the exception. Although new criminal law punishes those who have used force in asserting their rights, there is no effective means of dispute resolution outside of taking advantage of officials willing to look the other way in exchange for favors, or hiring thugs to more directly resolve disagreements. Citizens can buy justice through bribes, and law enforcement officials are especially helpful in these endeavors when their palms are greased. This is much more economical as well as effective than bringing a case to the relevant official agency, which is generally incapable of resolving problems and instead further exploits the situation.

On courts and lawyers…

For example, the most prominent role of the court in North Korea, where other types of lawsuit are very unusual, was to handle divorce settlements, since divorce through simple agreement of the two parties was not allowed. Ordinary citizens went so far as to perceive settlement of divorce to be the most important role of the court. Criminal cases were also unusual. Political crime is handled through a non-judicial process, while many deviances are resolved through unofficial processes within more local organizations. The role of the court in resolving disputes was negligible, aside from divorce. Since the role of law enforcement agencies is to protect the state and secure the socialist system, the most important qualification for them is not legal expertise, but rather, loyalty and devotion to the North Korean ideology and system.

On the other hand, the Lawyer’s Act of 1993 prescribes the required qualifications of a lawyer. Those who are eligible to work as lawyers are those who are certified legal professionals, those who have working experience of no less than 5 years in legal affairs, or those who have a professional license in a certain area and have passed the bar examination after a short-term course in legal education. This qualification for working as a lawyer signifies that the state wants to equip the judicial system with legal professionals. Although there is no explicit professional qualification for a judge or prosecutor, we may assume that legal professionals have been elected or recruited in practice. This trend is likely to be reinforced as these social changes continue to unfold.

New provisions were also introduced to reinforce the judicial system. For example, interference with a law enforcement official’s performance of duties is now a punishable offence ; Threatening a witness or exacting revenge has been criminalized ; Non-execution of judgment will now be punished. Although the introduction of these provisions was an expression of the government’s effort to bring in a more effective judicial system, it would not be an easy task under the vague status of transformation. The state is very cautious and reluctant to undertake bold or fundamental changes due to concerns about political instability. Therefore, it takes time for various coherent mechanisms to fully support a market system.

Although the P.R. of China and the DPRK are supposed to be as close together as “lips and teeth,” we have seen a couple of interesting stories emerging from Taiwan in the last few days.

Case 1: On Jan 8, the Straits Times reported that former Taiwanese president Chen Shui-bian embezzled money intended for the DPRK.

Case 2: Last Friday, the AFP reported that the US Treasury Depratment was moving on a Taiwanese couple who were allegedly facilitating shipping to the DPRK:

The US Treasury moved Friday to freeze the assets of a Taiwanese couple and their companies, linking them to North Korean weapons proliferation.

Alex HT Tsai and his wife Lu-chi Su were accused of providing support to the Korea Mining Development Trading Corporation (KOMID), identified by Washington as a proliferator four years ago, the Treasury said in a statement.

Tsai was last year indicted by Taiwanese authorities for forging shipping invoices and illegally shipping restricted materials to nuclear-armed North Korea, it said.

“He has been involved in shipping items to North Korea that could be used to support North Korea’s advanced weapons program,” the statement said.

The companies controlled by the couple Global Interface Co and its subsidiary Trans Merits Co. were sanctioned by the Treasury action.

“Proliferators depend on access to the international financial and commercial systems to support their dangerous trade,” said Stuart Levey, Treasury under secretary for terrorism and financial intelligence.

“Our action today exposes a North Korean procurement channel, and we urge governments and companies worldwide to cut this channel off entirely,” he said.
